General Terms and Conditions

Sec 1 General Terms and Validity
These General Terms and Conditions apply for the sale of products at the SOILart online shop. The media owner, the Office of the Lower Austrian Provincial Government, shall bear the project name SOILart below.

Sec 2 Conclusion of Contract
The orders placed by sending the order form are only seen as an offer for the conclusion of contract. SOILart is entitled to refuse orders without indicating the reasons thereof. The confirmations generated automatically about the receipt of an order shall not be understood as the acceptance of the offer by SOILart. The contract becomes valid by the performance of delivery of the order. The non-performance of delivery shall equal refusal of the offer.

Sec 3 Dispatch
Dispatch is effected to the address of delivery indicated:
The danger of destruction or damaging of the goods during transport is within the sphere of the buyer. SOILart assumes the costs of dispatch neither for domestic delivery nor for delivery abroad.

Sec 4 Payment
Insofar as delivery is not effected by cash on delivery, invoices shall be paid within a fortnight without deduction of any cash discount.
In case of delay of payment, beside expenses for reminders and collection of payment, interest for delay shall be charged in the amount of 12 % p.a. The sending of the invoice shall be effected to the address of delivery indicated by the merchant.

Sec 5 Payment
The prices indicated do not contain any VAT.
At the time of invoicing, no duty to collect VAT occurs, either.

Sec 6 Reservation of property
The SOILart products shall remain the sole property of SOILart until the invoice has been completely settled.

Sec 7 Warranty and compensation for damages
Regular customers shall be entitled to the customary terms of warranty and compensation for damages. The customer shall notify SOILart about complaints without any delay through forwarding the defective product together with a description of defects. The paintbox "with the Colours of the Earth" shall be granted a guarantee of exchange for 3 years. In case of defect, send to the product to:

Sec 8 Miscellaneous
SOILart expressly indicates that amendments to the General Terms and Conditions may be made. Therefore, it is recommended to read the GTC every time before placing an order. The invalidity of any single provision of these GTC does not affect any of the other provisions. The invalid provision shall be replaced by a valid provision, which, in legal and economic terms, comes closest to the meaning of the invalid provision.
Austrian law only shall apply, with the exclusion of the reference provisions of international private law and the UN purchase law. Sole court of jurisdiction for both partners to the contract shall be the court responsible for commercial matters in St. Poelten, Lower Austria.
